Harris County Municipal Utility District No. 109
(the "District") is a limited purpose political
subdivision created by the Texas Water Rights
Commission (predecessor to the Texas Commission on
Environmental Quality ("TCEQ")), by its order dated
July 16, 1974, pursuant to Article XVI, Section 59,
Texas Constitution and Chapters 49 and 54, Texas
Water Code. The creation of the District was
confirmed at an election held within the District
for that purpose on September 28, 1974. The District
is
empowered, among other things, to purchase,
construct, operate and maintain all works,
improvements, facilities and plants necessary for
the supply and distribution of water; the
collection, transportation, and treatment of
wastewater; and the control and diversion of storm
water.
The District is served with potable water by two
groundwater supply plants. Water Plant No. One
contains a 2,000 gallon per minute ("gpm") well,
420,000 gallon ground storage capacity, one million
gallon elevated storage capacity, four booster pumps
with total capacity of 4,750 gpm, and auxiliary
power. Water Plant No. Two contains a 2,000 gpm
well, one million gallon elevated storage capacity,
and emergency generator for auxiliary power.
Permanent wastewater treatment for Atascocita
(Harris County MUD Nos. 46, 132, 151, 152, 153 and
the District) is provided by a regional sewage
treatment plant (the "Regional Plant"), the cost of
which is being shared on a pro rata basis by the
participating districts.
